- What we collect. The identity, business, financial and credit information needed to assess your options and prepare your funding applications.
- Who sees it. The lenders and funders we submit your file to at your direction, the credit-report providers we use with your written authorization, and the service providers that run our portal, e-signatures, mail, payments and communications.
- What we never do. We do not sell personal information, and we do not share it with other companies for their own marketing.
- How it is protected. Encrypted in transit and at rest; Social Security and bank account numbers are stored encrypted with restricted, logged access.
- Your control. You can see, correct or delete your information, withdraw authorizations, and opt out of marketing at any time — contact details are below.
1. Who we are and what this policy covers
This Privacy Policy is issued by Orion Capital Funding LLC, a Wyoming limited liability company doing business as Orion Capital ("Orion Capital," "we," "us"). Our mailing address is 30 N Gould St, Ste N, Sheridan, WY 82801; we serve clients throughout the United States.
It explains how we handle information when you visit orioncapitalfunding.com, use our client portal at app.orioncapitalfunding.com, submit a form, book a call, or work with us on either of our two services: business funding brokerage (matching you with lenders and funders and preparing your applications) and business buildout (setting up and strengthening a business so lenders take it seriously).
If you engage us for any additional service under a separate written agreement, that agreement sets out any additional information practices that apply to it. Companies other than Orion Capital Funding LLC have their own privacy policies; this policy does not cover them.
2. Information we collect
Information you give us
- Identity and contact details — name, date of birth, Social Security number or ITIN, government ID, home address, phone, email.
- Business information — legal name, EIN, formation documents, ownership and officers, address, industry, time in business, licenses, website, and information about other owners or guarantors you are authorized to provide.
- Financial information — bank statements, tax returns, profit-and-loss and balance sheets, accounts receivable, existing debts and financing, merchant processing statements, and the amount and purpose of the funding you are seeking.
- Credit information — consumer and business credit reports and scores we obtain only with your written authorization, used to assess which lenders and funding options fit your profile.
- Documents and signatures — files you upload to the portal or send us, and agreements you sign electronically.
- Payment information — when you pay us, your card or bank details are collected and processed by our payment processor (Stripe). We receive confirmation details, not your full card number.
- Communications — emails, portal messages, text messages, notes from calls and meetings, and, where we tell you a call is recorded, the recording.
Information we collect automatically
- IP address, device and browser type, pages viewed, referring pages, dates and times of visits, and the cookies or similar technologies described in Section 8.
Information we receive from others
- Lenders and funders — the status and outcome of applications we submit for you, offers, and funding confirmations.
- Credit bureaus and credit-report providers — reports and scores, obtained with your written authorization.
- Identity-verification, fraud-prevention and sanctions-screening services, public records and business databases (for example Secretary of State filings and UCC records).
- Referral partners who introduce you to us, limited to the contact details needed to reach you.
3. How we use information
- To provide the services you request — assess your situation, prepare and submit funding applications to the lenders and funders we discuss with you, build your business profile, and keep you informed through the portal, email, phone and text.
- To verify identity and prevent fraud, including sanctions (OFAC) screening required of the lenders we work with.
- To run our business — billing and payments, customer support, quality review, training, record-keeping, and improving our website and services.
- To meet legal obligations, including the Fair Credit Reporting Act, the Gramm-Leach-Bliley Act and FTC Safeguards Rule, the Telephone Consumer Protection Act, state commercial-financing disclosure laws, and lawful requests from courts and regulators.
- To tell you about our own services, with your consent where required. You can opt out at any time (Section 11).
We do not use your information to make credit decisions — the lenders do. We do not sell personal information, and we do not use or disclose sensitive personal information (such as Social Security numbers, financial account numbers or precise identity documents) for any purpose other than providing the services you asked for, protecting against fraud, and complying with law.
4. How we share information
| Who | What and why |
|---|---|
| Lenders, funders, banks and other financial institutions | Your application package, when you ask us to submit it to them. We submit only to the lenders and funders we discuss with you, and you may ask us at any time where your file has been sent. |
| Credit bureaus and credit-report providers | The identifying information required to obtain your credit reports and scores with your written authorization. |
| Service providers working for us | Companies that host our client portal and data, deliver email and certified mail, provide e-signatures, process payments, provide credit-report access you enroll in, run our phone and messaging systems, and store our files. They may use your information only to provide services to us and must protect it. |
| Professional advisers | Lawyers, accountants and auditors, under confidentiality obligations. |
| Authorities and legal process | When required by law, subpoena or court order, to protect our rights or the safety of others, or to investigate fraud. |
| A successor business | If Orion Capital is merged, sold or reorganized, your information may transfer to the successor under this policy; we will notify you of any material change. |
| Anyone else | Only with your direction or consent. |
We do not sell personal information and we do not share it for cross-context behavioral advertising. We do not give your information to any other company for that company's own marketing.
Mobile information and SMS consent. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. SMS opt-in data and phone numbers collected for the purpose of SMS are not shared with any third party or affiliate company for marketing purposes.
5. Financial privacy notice (Gramm-Leach-Bliley Act)
As a business that arranges financing, Orion Capital handles nonpublic personal information about consumers and is subject to federal financial-privacy rules. Financial companies choose how they share your personal information; federal law gives you the right to limit some but not all sharing. This notice describes what we do.
| Reasons we can share your personal information | Does Orion Capital share? | Can you limit this sharing? |
|---|---|---|
| For our everyday business purposes — processing your applications, maintaining your account, responding to court orders and legal investigations | Yes | No |
| For our own marketing purposes — to offer our services to you | Yes | Yes — tell us to stop (Section 11) |
| For joint marketing with other financial companies | No | We do not share |
| For our affiliates' everyday business purposes | No | We do not share |
| For our affiliates to market to you | No | We do not share |
| For nonaffiliates to market to you | No | We do not share |
How we protect your information: see Section 9. How we collect it: when you apply for or use our services, upload documents, or authorize us to obtain your credit reports; we also collect it from lenders, credit bureaus and public records as described in Section 2. Why you can't limit all sharing: federal law lets you limit only sharing for affiliates' everyday business purposes (credit-worthiness information), affiliates' marketing, and nonaffiliates' marketing — and we do not share for any of those purposes. This notice applies to current and former clients.
6. Credit reports
- Written authorization first. We obtain your consumer credit report only in accordance with your written instructions, as permitted by the Fair Credit Reporting Act (15 U.S.C. §1681b(a)(2)). We do not resell credit reports, and we access them only to assess and prepare the funding options you have engaged us for.
- No hard inquiries without notice. Where a lender or funder will make a hard credit inquiry as part of an application we submit for you, we tell you before the application goes out.
- Credit-monitoring enrollments. If you enroll with a credit-report or monitoring provider so that we can retrieve your reports, that provider's own privacy policy governs its collection of your information. We store only the access details needed to retrieve your reports with your authorization, and you may revoke that access at any time.
7. Text messages (SMS), calls and email
How you opt in to text messages. We send text messages only to people who ask for them. You opt in by ticking the separate, unchecked-by-default SMS consent box on a form on orioncapitalfunding.com (for example the "Book a free call" or "Start an application" form), by texting a keyword such as START to support@orioncapitalfunding.com, or by giving your written consent to a member of our team. Consent to receive text messages is never a condition of any purchase or service. When you opt in we record your mobile number, the consent wording you agreed to, the date and time, the web page, and your device information, so that we can prove your consent.
What we text you. Messages are one-to-one customer-care messages about your request and your file: appointment confirmations and reminders, document requests, status updates on applications you asked us to submit, and replies to your questions. We do not send promotional text-message campaigns. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
How to opt out or get help. Reply STOP to any text message at any time and you will receive one final confirmation that you have been unsubscribed; we will not text you again unless you opt in again. Reply HELP for help, or call us at support@orioncapitalfunding.com or email support@orioncapitalfunding.com. You can also ask us to stop calls or emails the same way.
Who sees your mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message services, which act only on our behalf to deliver our messages. SMS opt-in data and phone numbers collected for the purpose of SMS are not shared with any third party or affiliate company for marketing purposes. We never sell mobile numbers or consent records.
Calls. By giving us your phone number you agree that Orion Capital may call you at that number about your inquiry, your file and our services, including with automated dialing technology where the law permits. We may record or monitor calls for quality and compliance; where we record, we tell you at the start of the call. Our full SMS program terms are at orioncapitalfunding.com/sms-terms/.
Email. We send service emails about your file (you cannot opt out of these while you are a client) and occasional marketing emails, which carry an unsubscribe link.
Portal notifications. The client portal can send you browser or app notifications; you control these in your device settings.
8. Cookies and analytics
Our website uses only the cookies and browser storage needed to work: session storage for your day/night display preference and security cookies for the client portal. We may use privacy-respecting, aggregated analytics to understand how the site is used. We do not use advertising cookies, and we do not sell or share browsing data. Because we do not sell or share personal information, browser "Do Not Track" and Global Privacy Control signals do not change how we treat you; we honor them where the law requires. You can clear or block cookies in your browser; the portal will not work without its security cookies.
9. How we protect information
- All connections to orioncapitalfunding.com and the client portal are encrypted (TLS). Data is encrypted at rest with our hosting providers.
- Social Security numbers and bank account numbers are stored encrypted, shown masked by default, and can be revealed only by authorized staff with a recorded business reason.
- Access is role-based and limited to the staff working your file; staff use unique accounts with multi-factor authentication, and access is logged.
- Documents you upload are stored privately and shared only through time-limited, signed links.
- Service providers are bound by contract to protect your information, and our safeguards program is designed to comply with the FTC Safeguards Rule (16 C.F.R. Part 314).
- If a breach affecting your information occurs, we will notify you and the authorities as required by law.
10. How long we keep information
We keep your information for as long as needed to provide the services, to document what was done on your file, and to meet legal, tax, accounting and record-keeping obligations — generally for up to seven years after our relationship ends, or longer if the law requires. Consumer information that is no longer needed for a business or legal purpose is securely disposed of, and in any event no later than two years after our last use of it, consistent with the FTC Safeguards Rule. Website visitor data that is not tied to a client file is kept only briefly for security and performance purposes.
11. Your choices and rights
- Access and correction. You can review and update most of your information in the client portal, or ask us for a copy of the personal information we hold about you.
- Deletion. You can ask us to delete your information. We will do so unless we need to keep it to complete services you requested, to comply with law, to resolve legal claims or to enforce our agreements — in which case we will tell you what we are keeping and why.
- Withdraw authorizations. You can withdraw your authorization for us to obtain credit reports or submit applications at any time. Withdrawal stops future actions; it cannot recall applications already sent.
- Marketing. Unsubscribe from any marketing email, reply STOP to any text, or tell us you do not want to be contacted about new services.
- Ask where your file went. Clients can request a list of the lenders and funders their file was submitted to.
To exercise any of these choices, email support@orioncapitalfunding.com with the subject "Privacy request" or call support@orioncapitalfunding.com. We will verify your identity using information already on your file before acting on a request, respond within 45 days, and never charge you or treat you differently for exercising your rights.
12. California and other state privacy rights
If you are a California resident, the California Consumer Privacy Act (as amended by the CPRA) may give you the right to know the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties we disclose it to; to correct inaccurate information; to delete your information; to opt out of the sale or sharing of personal information; to limit the use of sensitive personal information; and to be free from discrimination for exercising these rights. Information we collect subject to the Gramm-Leach-Bliley Act is exempt from the CCPA, but we apply these rights to all client information as a matter of policy, whether or not the law technically requires it.
In the 12 months before the effective date of this policy we collected the categories of personal information listed in Section 2 and disclosed them for business purposes to the categories of recipients listed in Section 4. We have not sold or shared personal information, and we do not knowingly collect or sell the personal information of anyone under 16. You may designate an authorized agent to make requests for you; we will ask for proof of the agent's authority and verify your identity.
Residents of Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, Virginia and other states with consumer privacy laws have similar rights to access, correct, delete and port their information and to opt out of targeted advertising, sales and certain profiling. We do not engage in targeted advertising, sales or automated decision-making about you. Submit any state privacy request through the contact details in Section 14; if we decline a request you may appeal by replying to our response, and we will answer the appeal in writing.
13. Children, third-party links and changes
Children. Our services are for adults and businesses. We do not knowingly collect information from anyone under 18; if we learn that we have, we delete it.
Third-party sites. Our site and portal link to lenders, credit-report providers and other companies. Their privacy practices are their own; read their policies before providing information to them.
Changes. We will post any changes to this policy on this page with a new effective date and, for material changes, notify current clients through the portal or by email. Continued use of our services after a change means you accept the updated policy.
